Roe v. Wade, the Supreme Court decision that guarantees the right to abortion, with caveats based on the viability of the fetus and health of the mother, is an apt reflection of a national ambivalence that nonetheless decisively tips toward the rights of the woman over the rights of the fetus.

Democratic Sen. Richard Blumenthal of CT, who is on the Senate Judiciary Committee that holds hearings on Supreme Court nominees, responded on "This Week" that Trump has "outsourced" his decision to the Federalist Society and the Heritage Foundation, which helped compile a list of 25 potential nominees from which the president has said he would make his selection.

Many analysts also agree that even with the Supreme Court's likely philosophical shift, Roe v. Wade might not actually be overturned at all.

Overturning Roe would accelerate the process, abortion rights activists say, because states would no longer have to worry about a federal judge standing in their way.

I think abortion opponents will have that trust vindicated; I think a Roberts-Kavanaugh court, however restrained in other ways, will overrule Casey and allow the states to legislate freely on abortion once again.

Such a decision is increasing in likelihood in a world where the Supreme Court is made of a conservative majority. Republican Senator Susan Collins has stated publicly she will not support a Supreme Court Justice hostile to Roe v. Wade.

Public opinion on abortion has been remarkably stable in recent decades, with significant but never overwhelming majorities supporting legal yet restricted abortion rights.

As of now, four states - Louisiana, Mississippi and North and South Dakota - have what are known as abortion "trigger laws". "Roe v. The idea that it was Roe that produced legal abortion in the United States is a modern myth that no pro-life activist in 1973 believed. A mere reversal of Roe would not have stopped New York, California, and other states from offering legal abortion for both residents and non-residents.

Most Republicans want to put the Supreme Court out of reach of the left for a generation or more. But he sided with conservatives this year when the court upheld Trump's ban on travel from predominately Muslim countries.

That law was struck down by the Supreme Court, as she pointed out, by the vote of five justices in 2016 in the case of Whole Woman's Health v. Hellerstedt.

All this means the outcome of a confirmation vote is uncertain.

"Red-state Democrats are going to have a very hard decision, and I hope every Republican will rally behind these picks, because they are all outstanding", he said.
