Turner had all his clothes on when two graduate students spotted him behind a dumpster atop an unconscious woman who was patrially clothed.

Turner, a former student athlete at Stanford University, was found guilty in 2016 of assault with intent to commit rape, sexual penetration of an intoxicated person with a foreign object, and sexual penetration of an unconscious person with a foreign object, according to KNTV, NBC News' San Francisco Bay Area affiliate.

Although prosecutors had sought a six-year term, Turner was sentenced to six months and released after serving only three.

The attorney made the case, arguing the jury made "unreasonable inferences" leading to the conviction, in front of a three-justice panel on Tuesday in an appeals court in California, reported Dayton Daily News.

"I absolutely don't understand what you are talking about", said Justice Franklin Elia.

Three California appellate justices have 90 days to discuss Multhaup's appeal argument as well as issue a ruling on the appeal.

The judge presiding over the trial - Aaron Persky - was recalled from the bench after public scrutiny for being too lenient.
