Supreme Court nominee Judge Brett Kavanaugh, President Donald Trump's choice to replace retiring Justice Anthony Kennedy, arrives for a private meeting with Sen.

"I have expressed my concern over Judge Kavanaugh's record on warrantless bulk collection of data and how that might apply to very important privacy cases before the Supreme Court", said Paul.

Manchin previously said he wants to meet Kavanaugh before his Senate Judiciary Committee hearing as well as afterward.

Depending on turnout at the time of the vote, Democrats will likely need all 49 members of their caucus to vote against confirmation and then persuade one or two Republicans to vote against Judge Kavanagaugh as well. The senator has also asked West Virginia residents to send him questions for the meeting.

Mr. Paul was one of three Republicans whom Democratic leaders hoped to sway to vote against confirmation, along with Sen.

Schumer, who has pledged to oppose the nomination "with everything I have", acknowledged the difference of opinion on the nomination in the letter, but said Bush should still support a full view of Kavanaugh's records.

But Democrats are demanding that Republicans release thousands of pages of documents from when Kavanaugh served as a senior official in George W. Bush's White House before he became a judge.

Democrats and Republicans have sparred in particular this week over Kavanaugh's staff secretary records.

Paul's concerns centered on Judge Kavanaugh's 2015 statement concurring in the denial of rehearing en banc in Klayman v. Obama, which was then before the U.S. Court of Appeals for the District of Columbia Circuit.

Manchin is one of a handful of vulnerable incumbent Democrats vying to hold on to his seat in the midterm election this fall. "Manchin making a craven political calculation once the outcome has already been decided", Morrisey said. North Dakota's Heidi Heitkamp and Indiana's Joe Donnelly, like Manchin, are running for re-election this year.

In HuffPost/YouGov's polling, net support for confirming Kavanaugh was 13 percentage points lower than net support for Gorsuch; that gap was 6 points in a Fox News survey and 7 points in both Pew Research and Gallup's polling. Rand Paul announced after he met with Kavanaugh that he would support the nominee, despite earlier voicing reservations about Kavanaugh's commitment to privacy rights. This mentality drastically differs from that of Democrats, who believe they'll be hurt by a government shutdown and have little leverage to combat Republican demands. Shelley Moore Capito, R-W.Va., met with Kavanaugh July 12.
